M.K.I. I have been working in a private company in Jeddah for seven years and five months. My contract has been renewed automatically during this period. If I resign what would be my end-of-service benefit and how would it be calculated if the company terminates my service.

As yours is an specified-period contract, you must not resign before it ends. Your company can say that you have breached your contract. When your contract ends, you may write to your company that you want to leave. Your ESB will be half your last monthly wage (LMW) for each of the first five years and a full LMW for each of the remaining years. LMW is not just your last salary, in addition to that must be added to it all your allowances monthly average.


 

A.B.C. I have been working for a company for more than five years. I did not sign any contract. First, I worked for them for a year before my sponsorship was transferred to them. Now I am planning to resign. They have informed me that my first year will not be included in my end-of-service benefit (ESB) calculation as I was not under their sponsorship. They also want me to pay for my air ticket. Please advise.

According to law, your first year of service should also be calculated in your ESB. Your ESB should be calculated from the first day of your work irrespective of the fact that you came under their sponsorship after one year. If you resign by giving your employer 30 days prior written notice your company has to pay you the air fare for travel to your home country.


 

I.J.N. I have been working in a private company in Riyadh for the past two years. My contract will expire on Nov. 16, 2008. The company said they won’t need my services after my contract ends. They have not given me any official letter but informed me verbally. I took transfer to this company from other local company. I have been working in Saudi Arabia since November 1999. My question is, can I get release from my current employer. What shall I do first to start the process? My CEO told me to look for another job. But what if they don’t agree to give me release and let me join another company?

Since you were not informed by your company concerning the renewal of your contract, you should assume that they want to dismiss you. Better write to them that you do not wish to renew the contract. Find another employer and let your company carry out the transfer procedures. I do not see any problem.
